Worth knowing
- You have not stated any permission. Letting without permission can cost you your own home — make sure permission is in place before the agreement is signed.
- For a rental apartment it is also a criminal offence to sublet without permission while charging a rent that is not fair: the penalty is a fine or up to two years’ imprisonment, and minor cases are not punished (Chapter 12, § 65 c of the Land Code).
- The letting can run for more than two consecutive years. At that point the subtenant gains security of tenure against you (Chapter 12, § 45 of the Land Code). To avoid it you need to agree a waiver of security of tenure in a separate document — putting it in the contract is not enough. If you will move back yourself (or sell the co-op apartment), such a waiver is valid without the Rent Tribunal’s approval for up to four years; otherwise the Tribunal must approve it (Chapter 12, § 45 a of the Land Code).
